Abstract
This research article presents a critical and analytical study of the scope of talfīq bayn al-madhāhib in the reconstruction of Islamic jurisprudence. Islamic jurisprudence is a comprehensive legal and ethical system derived from the Qur’an, Sunnah, ijmāʿ and ijtihād. With the emergence of modern social, economic, financial and biomedical issues, contemporary Muslim societies require juristic solutions that remain faithful to the foundational principles of Sharīʿah while responding to changing circumstances. The study examines the linguistic and technical meanings of talfīq, its major types, and the views of the four Sunni schools of law regarding its permissibility and limitations. It also explores the practical application of talfīq in contemporary fields such as Islamic finance, social transactions, organ transplantation, assisted reproduction and life-support systems. The article argues that talfīq is neither absolutely prohibited nor unrestricted; rather, its validity depends upon recognized juristic conditions, avoidance of tatabbuʿ al-rukhaṣ, preservation of ijmāʿ, and conformity with maqāṣid al-sharīʿah. The study concludes that principled and collectively guided talfīq can serve as a useful methodological tool for addressing contemporary fiqh issues without compromising the integrity of Islamic law.
